4 Things Every Tamil Nadu Employer Must Do
Paying the right wage is step one. Labour inspectors check all four.
Pay the Correct Zone-Wise Rate
Apply the rate matching the location of each branch. Chennai (Zone A) is highest, village panchayats (Zone D) lowest. No private contract can override the Minimum Wages Act - even a signed agreement paying less is void. Update wages within 30 days of each revision.
Maintain Statutory Registers
Wage register and muster roll in the prescribed Tamil Nadu format must be produced on demand by labour inspectors. Show Basic and VDA separately. Maintain an inspection book. File annual returns with the Labour Commissioner.
Pay on Time and Overtime Correctly
Wages must be paid before the 7th of the following month (under 1,000 workers) or 10th (larger firms). Overtime at twice the ordinary rate for work beyond 9 hours/day or 48 hours/week.
Display the Wage Notice in English & Tamil
The notification must be displayed prominently at the workplace entrance in both English and Tamil. Refresh within 30 days of every revision. Inspectors check this on every visit.
Penalty for Non-Compliance
Under the Code on Wages, 2019 (in force from 21 November 2025): fine up to ₹50,000 for a first offence, and up to ₹1,00,000 + 3 months imprisonment for a repeat offence within five years. The employer is also liable to pay full wage arrears with compensation. Failure to maintain wage records carries a fine up to ₹10,000. The Tamil Nadu Labour Department conducts surprise inspections in retail, hospitality, manufacturing, and security - year-round.

Code on Wages 2019 • What Changes for Tamil Nadu
The Code on Wages, 2019 came into force across India on 21 November 2025, replacing four central labour laws including the Minimum Wages Act, 1948. The Code creates a single framework for wages, but Tamil Nadu's existing notifications continue to apply until state rules under the Code are notified.
Universal coverage
The Code extends minimum wage protection to all employees, not just those in scheduled employments. The old scheduled-employment carve-out is removed.
National floor wage
The Central Government will notify a national floor wage. No state can fix its minimum wage below this floor.

Is Tamil Nadu Minimum Wages Act still applicable?
Yes. By virtue of the Repeal & Savings clause in the Code, read with Section 6 of the General Clauses Act, 1897, Notification No. Z3/3459/2026 and the existing zone structure remain fully enforceable until Tamil Nadu publishes state-level Code rules. Where any provision of the Code conflicts with the existing state rules, the Code prevails.

Minimum wage is the gross amount paid to the worker. On top of this, the employer pays: PF at 12% of Basic, ESI at 3.25% of Gross (if wage ≤ ₹21,000), statutory bonus at 8.33%, and a gratuity provision of 4.81% of Basic. Total CTC for a Zone A Helper works out to ~₹16,796/month - about 19.6% above the gross minimum wage.
